Terms of Service
Last updated: October 7, 2026
These Terms of Service ("Terms") govern your use of vistamountaz.com, portal.vistamountaz.com, and any installation, mounting, audio-visual service, or physical product you purchase from VistaMount LLC ("VistaMount," "we," "us," or "our").
By booking a service, signing a service agreement, purchasing a product, or using the Site, you agree to these Terms. If you do not agree, please do not book a service or place an order.
1. Licensing Disclosure
VistaMount LLC is not a licensed contractor.
We perform work falling within the exemption from contractor licensing under A.R.S. § 32-1121(A)(14): work of a casual or minor nature, on a single undertaking, where the aggregate contract price is under the statutory threshold and no building permit is required.
- If a job would exceed that threshold or require a permit, we will tell you before work begins and either decline the job or refer it to an appropriately licensed contractor.
- We do not perform line-voltage (120V) electrical work. Any new outlet, circuit, or hardwired power installation is quoted and performed by a separately engaged licensed electrical contractor, under their own agreement with you.
- Because we are not licensed by the Arizona Registrar of Contractors, work performed by VistaMount is not covered by the Arizona Residential Contractors' Recovery Fund, and the ROC does not have jurisdiction over disputes about our work.
2. Services
VistaMount provides television mounting, soundbar and speaker installation, cord concealment, feature wall and gallery installation, mount and hardware supply, smart home device installation, and related audio-visual setup in the Phoenix, AZ metro area. Services and pricing are described on the Site and are subject to change. All services are subject to the Service Agreement you accept at the time of booking.
3. Product Orders, Shipping, and Returns
Physical product purchases, including MantelMount mounts and accessories, are governed by our Product Order Policy. That policy covers acceptance, estimated delivery, shipping charges, cancellations, return authorization, refunds, manufacturer warranties, and transaction review. Installation remains a separate service governed by these Terms.
4. Quotes, Pricing, and Surcharges
- Prices shown on the Site are estimates based on the information you provide. Final pricing is confirmed on site before work begins, and you must authorize the final price before services are rendered.
- Pricing varies by TV size, service zone, and travel distance from downtown Phoenix.
- Additional charges may apply for metal studs, concrete, brick, stone, tile, or plaster-and-lath walls; mounting heights over ten feet; outdoor installations; Frame-style or flush-mount televisions; same-day service; specialty mounts; and in-wall cord concealment tiers.
- If conditions at the property differ materially from what you described, we will present a revised price for your approval before continuing. You may decline and cancel at that point, subject to the booking policy in Section 8.
- Booking an appointment does not guarantee availability until confirmed by VistaMount. We will contact you to confirm.
- Prices exclude applicable Arizona transaction privilege tax and any local tax.
5. Scheduling and Access
- Appointment times are arrival windows, not guaranteed exact times. Traffic, prior job complexity, and weather can shift arrival.
- An adult 18 or older, authorized to approve the work and its placement, must be present for the entire appointment.
- You must provide safe, clear, legal access to the work area, including parking, elevator or freight access, gate or building codes, and any HOA or property-management approval.
- Please clear furniture, decor, and fragile items from the work area before we arrive, and secure pets.
- If we cannot access or safely perform the work on arrival, the appointment is treated as a same-day cancellation under Section 8.
6. Your Representations About the Property
You represent that you own the property, or have the owner's, landlord's, or HOA's permission to have permanent alterations made, including drilling, anchoring, and cutting drywall.
You agree to disclose to us, before work begins, anything you know or reasonably should know about the wall or structure, including:
- Prior repairs, water damage, or unusual construction
- Wiring, plumbing, gas lines, or ductwork behind the intended mounting surface
- Post-tension cables, radiant heating, or structural elements
- Asbestos, lead paint, or other hazardous materials
We rely on your disclosures. We use standard detection tools, but no tool reliably identifies everything inside a wall. VistaMount is not responsible for damage to concealed items that were not disclosed and were not reasonably detectable, or for pre-existing conditions.
7. Warranty
- VistaMount warrants all labor and workmanship for 1 year from the service date. If a mount we installed loosens, shifts, or fails due to our workmanship, we will re-secure or reinstall it at no labor cost.
- This warranty covers the quality of the installation work only. It does not cover the television, or mount hardware supplied by the customer.
- Mounts and hardware we supply carry the manufacturer's warranty. We will help you file a manufacturer claim but do not extend our own warranty beyond it.
- Customer-supplied mounts, brackets, anchors, cables, and televisions are installed at your risk. We do not warrant customer-supplied hardware, and we may decline to install any item we judge unsafe, undersized, damaged, counterfeit, or incompatible.
- The warranty does not cover damage caused by the customer or third parties, misuse, acts of nature, moving or bumping the television, subsequent work by others, building settlement, water intrusion, power events, or normal wear.
- Warranty claims must be reported within the warranty period using the contact details in Section 20.
8. Booking, Cancellation, Rescheduling, and No-Shows
Effective October 28, 2026, deposits are temporarily suspended for new service bookings. No deposit or card payment is required to reserve a new installation appointment. Payment is due after installation.
- Contact us promptly if you need to cancel or reschedule. Changes are subject to availability and written confirmation by VistaMount.
- The selected appointment time starts a one-hour arrival window.
- Any deposit already paid remains credited toward the final invoice and subject to the terms accepted when that booking was made. This suspension does not automatically refund existing deposits.
- Physical product orders follow the separate Product Order Policy.
- No refunds are offered for completed services. Our one-year workmanship warranty remains in effect.
- Nothing in this policy limits rights or remedies that cannot lawfully be waived.
9. Payment
- Payment, after crediting any deposit already paid, is due in full on completion, unless agreed otherwise in writing.
- We accept the payment methods listed at checkout. Card payments are processed by our payment provider under their terms.
- Past-due balances may accrue interest at 1.5% per month, or the maximum allowed by Arizona law, whichever is less, plus reasonable costs of collection.
- Chargebacks. If you dispute a charge for work that was completed and accepted, you agree to contact us first and give us a chance to resolve it. Filing a chargeback for completed and accepted work without first contacting us is a breach of these Terms, and you agree to reimburse our reasonable costs of responding, including dispute fees.
10. In-Wall Cord Concealment — Additional Terms
In-wall cord concealment requires cutting into finished drywall.
- We use only cable rated for in-wall installation where the cable will remain in the wall.
- We do not run standard, non-rated power cords inside a wall. Where in-wall power is requested, we install a code-compatible in-wall rated power solution, or refer the line-voltage work to a licensed electrician.
- Drywall cuts are made as small as practical and are covered by the installed plates. We do not perform drywall patching, texture matching, or painting — cosmetic finishing is your responsibility.
- Fire blocks, insulation, HVAC ducts, structural members, and unexpected obstructions can make a clean route impossible. If we hit one, we stop, show you, and offer an alternative route or an on-wall solution. Work already performed is billable.
- You must accept our In-Wall Wiring Acknowledgment before this work begins.
11. Damage and Claims
VistaMount carries general liability insurance. A certificate is available on request.
If damage occurs during our work:
- Notify us within 72 hours of the appointment, in writing, with photographs.
- Give us a reasonable opportunity to inspect before any repair is made.
- We will repair, arrange repair, or reimburse the reasonable cost of repair, at our option.
Claims not reported within 72 hours, or where repair was performed before we could inspect, may be denied.
12. Photographs and Portfolio Use
You grant VistaMount permission to photograph and video the completed installation and to use those images in our portfolio, website, advertising, and social media. Images will not include identifying personal information, house numbers, or full addresses. You may opt out at any time, before or after the job, by telling us in writing, and we will remove the images from channels we control.
13. Limitation of Liability
To the fullest extent permitted by Arizona law:
- VistaMount's total liability arising out of or relating to any job or these Terms is limited to the greater of the amount you paid for that job or the applicable coverage available under our general liability insurance.
- VistaMount is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of use, loss of data, lost profits, or loss of business, even if advised of the possibility.
- We are not responsible for pre-existing conditions, hidden obstructions, or damages caused by circumstances outside our control.
Nothing in these Terms limits liability for gross negligence, willful misconduct, fraud, or bodily injury caused by us, or any liability that cannot be limited by law. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless VistaMount LLC and its owner, employees, and subcontractors from claims, damages, and reasonable costs arising out of: your breach of these Terms; your failure to disclose conditions under Section 5; your lack of authority to authorize permanent alterations to the property; or your misuse of the installed equipment.
15. Dispute Resolution
Informal resolution first. Before starting any formal proceeding, you agree to contact us and give us 30 days to resolve the dispute.
Governing law. These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-laws rules. Disputes shall be resolved in Maricopa County, AZ.
Arbitration. Any dispute not resolved informally will be settled by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Maricopa County, Arizona. Judgment on the award may be entered in any court of competent jurisdiction.
Exceptions. Either party may bring a claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property or prevent unauthorized use of the Site.
Class action waiver. Disputes will be brought only in an individual capacity, not as a plaintiff or class member in any class, collective, or representative proceeding. If this waiver is found unenforceable, the arbitration agreement in this section is void as to that claim.
Opt out of arbitration. You may opt out by emailing [email protected] with the subject line "Arbitration Opt-Out" within 30 days of your first booking. Opting out does not affect any other part of these Terms.
16. Site Use
- Content on the Site — text, photographs, logos, and the VistaMount name and marks — is owned by VistaMount and may not be copied or reused without permission.
- You may not scrape the Site, submit false booking information, interfere with the Site's operation, or use the Site for any unlawful purpose.
- The Site is provided "as is." Availability, arrival windows, and pricing displayed on the Site may change without notice.
17. Communications
Your use of our text messaging and calling programs is governed by our Messaging & Calling Terms and our Privacy Policy.
18. Changes to These Terms
We may update these Terms at any time. The "Last updated" date will change. The Terms in effect on the date you book govern that job, and continued use of our services constitutes acceptance of updated Terms.
19. Miscellaneous
If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms, together with the Service Agreement you accept at booking, are the entire agreement between us regarding your job.
